Eviction Desk Terms of Service

Effective date: September 3, 2026

These Terms of Service (the “Terms”) govern access to and use of Eviction Desk, a software service provided by Eviction Desk LLC (“Eviction Desk,” “we,” “us,” or “our”). By accessing or using Eviction Desk, or by signing in after being presented with a link to these Terms, you agree to these Terms on behalf of yourself and, if applicable, the organization through which you use the Service (the “Customer”). If you do not agree, do not use the Service.

1. Business use and authority

Eviction Desk is intended for business and professional property-management use. You must be at least 18 years old and authorized by the Customer to use the Service. If you use Eviction Desk on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. The Service

Eviction Desk provides software tools that may include organization and user administration, scheduled monitoring of publicly available court-index information, case tracking and daily updates, report export and email delivery, and generation of eviction-related forms from information supplied by users.

Features may change over time. We may modify, suspend, or discontinue features when reasonably necessary for security, legal compliance, maintenance, third-party service changes, or product development.

3. Not a law firm; no legal advice

Eviction Desk is software, not a law firm, and does not provide legal advice or legal representation. Use of the Service does not create an attorney-client relationship.

Generated documents are based on information supplied by the Customer or its users. The Customer is responsible for reviewing every generated document for factual accuracy, completeness, legal sufficiency, proper execution, notarization, service, filing requirements, deadlines, and compliance with applicable law and court rules before relying on or filing it.

Eviction Desk does not determine whether an eviction should be filed, whether a legal claim or defense is valid, which legal procedure is appropriate, or what legal strategy a Customer should follow. Consult a licensed attorney for legal advice about a specific matter.

4. Court and public-index information

Court and public-index information made available through Eviction Desk is informational only. Court websites and public records can be delayed, incomplete, unavailable, changed, blocked, or inaccurate. Eviction Desk may check supported public sources on a managed schedule, but the Service is not a real-time court docket and does not guarantee that every filing, event, disposition, or status change will be detected or detected by any particular time.

The Customer remains responsible for independently verifying official court records and complying with all deadlines, notices, hearings, filing requirements, and other legal obligations. The Customer must not rely on Eviction Desk as the sole source for a court deadline, legal status, or required action.

5. Form generation

The form generator uses Customer-supplied data to populate document templates. Eviction Desk does not file documents with a court, sign documents for the Customer, notarize documents, serve process, or represent the Customer in any proceeding.

Input formats, court forms, and court requirements may change. The Customer must review generated documents before use and is responsible for maintaining its own source records and final filed copies.

6. Customer data and permissions

The Customer retains its rights in information and files submitted to the Service (“Customer Data”). The Customer grants Eviction Desk a limited right to host, process, transmit, copy, and otherwise use Customer Data only as reasonably necessary to provide, secure, maintain, support, and improve the Service; comply with law; and enforce these Terms.

The Customer represents that it has the rights, permissions, and lawful basis necessary to provide Customer Data to Eviction Desk and to use the Service with that data. The Customer is responsible for the accuracy of Customer Data and for its users’ use of the Service.

7. Accounts and security

Users must provide accurate account information, protect credentials, use multifactor authentication when required, and promptly report suspected unauthorized access. Accounts may not be shared outside the Customer’s authorized users.

Organization administrators control organization settings and user access. The Customer is responsible for promptly disabling access when a user should no longer have access to its data.

8. Temporary generated-file storage

Generated form artifacts are intended to be temporary. Unless the Service states otherwise, generated files are generally available for approximately 24 hours and may then be automatically deleted. Batch-history or audit metadata may remain after generated files expire.

The Customer is responsible for downloading and retaining any documents it needs for business or legal records. Eviction Desk is not a permanent document-management or court-record archive.

9. Acceptable use

You may not use the Service to violate law, court rules, third-party rights, or contractual obligations; gain unauthorized access to systems or data; interfere with the Service or third-party services; bypass technical or security restrictions; introduce malicious code; or use another Customer’s data without authorization.

You may not resell, sublicense, copy, reverse engineer, or create derivative works from the Service except to the extent such restrictions are prohibited by law or expressly authorized in writing by Eviction Desk.

10. Third-party services

Eviction Desk depends on third-party infrastructure, communications, storage, court websites, and other services. Those systems are outside our control and may be changed, interrupted, limited, or discontinued. Eviction Desk is not responsible for a third party’s independent acts or omissions, but we will use commercially reasonable efforts to operate and maintain the Service.

11. Fees and payment

If the Customer purchases paid access, fees, billing intervals, included usage, and any other commercial terms may be stated in an order form, invoice, subscription page, or other written agreement. Unless otherwise stated, fees are nonrefundable except where required by law.

If there is a conflict between these Terms and a signed order form or other written agreement with Eviction Desk, the signed agreement controls for that conflict.

12. Intellectual property

Eviction Desk and its software, design, branding, documentation, and related technology are owned by Eviction Desk LLC or its licensors and are protected by applicable intellectual-property laws. Except for the limited right to use the Service under these Terms, no rights are transferred to the Customer.

The Customer owns its Customer Data. Public court information remains subject to the rights and restrictions applicable to its source.

13. Confidentiality

Each party may receive nonpublic information from the other that a reasonable person would understand to be confidential. The receiving party will use such information only for the relationship contemplated by these Terms and will use reasonable measures to protect it. This section does not apply to information that is public through no breach of these Terms, already lawfully known, independently developed, or lawfully received from another source without a duty of confidentiality.

14. Suspension and termination

We may suspend access when reasonably necessary to address security risks, suspected unlawful use, material breach, nonpayment, third-party platform restrictions, or threats to the Service or other users. We will use reasonable efforts to provide notice when practical.

The Customer may stop using the Service at any time, subject to any separate payment or subscription commitments. Upon termination, access may end and Customer Data may be deleted according to our retention practices and legal obligations.

15. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” EVICTION DESK DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE, COURT DATA, GENERATED DOCUMENTS, NOTIFICATIONS, EMAILS, OR THIRD-PARTY SYSTEMS WILL BE ERROR-FREE, COMPLETE, CURRENT, UNINTERRUPTED, OR SUITABLE FOR A PARTICULAR LEGAL MATTER.

Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

16. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVICTION DESK LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST BUSINESS, LOSS OF DATA, OR COSTS ARISING FROM MISSED COURT EVENTS, DEADLINES, FILINGS, SERVICE REQUIREMENTS, OR RELIANCE ON PUBLIC-INDEX INFORMATION OR GENERATED DOCUMENTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVICTION DESK’S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS PAID BY THE CUSTOMER TO EVICTION DESK FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

These limitations apply regardless of the legal theory and even if a remedy fails of its essential purpose, but they do not apply to liability that cannot lawfully be limited.

17. Indemnification

To the extent permitted by law, the Customer will defend, indemnify, and hold harmless Eviction Desk LLC and its owners, officers, employees, contractors, and agents from third-party claims, damages, liabilities, and reasonable costs arising from the Customer’s Customer Data; the Customer’s or its users’ unlawful or unauthorized use of the Service; or the Customer’s violation of these Terms or third-party rights. This obligation does not apply to the extent a claim was caused by Eviction Desk’s own unlawful conduct.

18. Governing law and venue

These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law rules. Unless the parties agree otherwise in writing, exclusive venue for disputes relating to these Terms or the Service will lie in the state or federal courts with jurisdiction in Richland County, South Carolina, and each party consents to personal jurisdiction there.

19. Electronic communications

You agree that agreements, notices, disclosures, and other communications may be provided electronically, including through the Service or by email, to the extent permitted by applicable law.

20. Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms and revise the effective date. If a change materially affects existing paid Customers, we will use reasonable efforts to provide notice through the Service, email, or other account communications before the change takes effect where appropriate.

21. Contact

Questions about these Terms may be directed to Eviction Desk LLC using the business contact information provided in your account, invoice, order form, or other Eviction Desk communications.
